1. Definitions
In this Agreement, the following terms have the meanings set out below:
- "Nestbridge", "we", "us", "our": refers to the business operating under the name Nestbridge, registered in Sarawak, Malaysia, with its office at 22, Jalan Song, 93350 Kuching, Sarawak.
- "Service" or "Programme": refers to any of the educational workshops and organisation sessions offered by Nestbridge, including the Gentle Dialogue Workshop, the Family Paperwork Organisation Session, and the Family Wellbeing Coordination Programme.
- "User" or "you": any individual or family group who accesses our website, submits an enquiry, or attends a programme.
- "Agreement": these Terms and Conditions in their current version.
- "Content": all written materials, guides, templates, and binders produced and provided by Nestbridge.
2. Acceptance of Terms
By using our website, submitting an enquiry, or booking a programme, you confirm that you have read and accepted these Terms and Conditions in full. These terms form a binding agreement between you and Nestbridge.
Our programmes are intended for individuals aged 18 and over. By booking, you confirm that all participating adults are 18 or older, or that you are a parent or guardian responsible for any younger family members involved.
3. Nature of Services
Nestbridge provides educational workshops and practical organisation sessions only. All programmes are general and skills-based in nature. Nothing delivered by Nestbridge constitutes:
- Legal advice or representation
- Financial advice
- Counselling, therapy, or psychological treatment
- Social work or official mediation
We actively direct participants to appropriate licensed professionals for any matters that fall outside educational scope. Our services are available primarily in Kuching, Sarawak. Remote participation may be accommodated at our discretion.
4. Booking and Confirmation
A programme booking is confirmed only when Nestbridge has sent a written confirmation (by email or letter). Submitting an enquiry form does not constitute a booking.
We reserve the right to decline any enquiry or booking request where we reasonably determine that our services are not appropriate for the family's stated situation.
5. User Responsibilities
By attending a programme, you agree to:
- Participate in sessions in good faith and with respect toward other participants and the facilitator.
- Provide accurate information at the intake stage.
- Acknowledge that Nestbridge does not provide advice and that all decisions remain your own.
- Not record sessions (audio or video) without prior written consent from Nestbridge and all other participants.
- Not use materials provided by Nestbridge for commercial purposes without written authorisation.
6. Intellectual Property
All guides, templates, checklists, and binders produced and provided by Nestbridge ("Content") remain the intellectual property of Nestbridge. A limited, non-exclusive licence is granted to you for personal and family use only. You may not reproduce, distribute, or sell Nestbridge Content to third parties.
The Nestbridge name, logo, and website content are protected. Unauthorised use is not permitted.
7. Fees and Payment
Programme fees are as stated on our website and confirmed in writing at the time of booking. All fees are in Malaysian Ringgit (RM) and include GST where applicable under current Malaysian law.
Payment is accepted by bank transfer or such other methods as may be agreed at the time of booking. Payment is due prior to the session date unless a staged arrangement has been agreed in writing.
Cancellation policy: If you cancel more than 5 business days before a session, a full refund is provided. If you cancel within 5 business days, a 50% fee is retained to cover facilitator time and preparation. If Nestbridge cancels a session, a full refund is provided or an alternative date is offered.
8. Session-Specific Terms
- Gentle Dialogue Workshop: A single session delivered at our Kuching office. The programme includes a take-home guide. Written session summary provided within 48 hours.
- Family Paperwork Organisation Session: A single session requiring participants to bring their own documents as per the pre-session checklist. Nestbridge is not responsible for documents brought to the session. Organisation produced is solely the family's responsibility to maintain.
- Family Wellbeing Coordination Programme: A multi-session programme. Scheduling is agreed at intake. The follow-up check-in is included and is conducted by phone. All sessions are non-advisory in scope.
9. Disclaimers
Services are provided on an educational basis only. Nestbridge makes no statement, representation, or implication regarding outcomes for any participant. Family situations are complex, and Nestbridge does not represent that its programmes will resolve disputes, improve relationships, or produce any specific result.
Nestbridge is not responsible for decisions made by participants after attending a programme. All decisions remain the participants' own.
10. Limitation of Liability
To the extent permitted by Malaysian law, Nestbridge's total liability to you arising from or in connection with any programme shall not exceed the amount you have paid for that specific programme.
Nestbridge shall not be liable for any indirect, consequential, or special loss, including loss of income, loss of data, or reputational harm, arising from your participation in any programme or from your use of the Nestbridge website.
Nestbridge is not liable for events beyond its reasonable control, including but not limited to illness, severe weather, public health restrictions, or facility unavailability.
11. Indemnification
You agree to indemnify and hold Nestbridge harmless from any claim, loss, damage, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of any Nestbridge Content, or any misrepresentation made by you at the intake or booking stage.
12. Termination
Nestbridge may terminate a booking or programme engagement at any time if a participant's conduct during a session is disrespectful, threatening, or causes disruption to other participants or to the facilitator. In such cases, a partial refund may be provided at Nestbridge's discretion.
You may withdraw from a programme at any time, subject to the cancellation policy set out in clause 7.
13. Dispute Resolution
We encourage any concerns to be raised directly with us first. Please write to [email protected] or call +60 82 457 138. We will respond within 10 business days and aim to resolve matters informally where possible.
This Agreement is governed by the laws of Malaysia. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Sarawak, Malaysia.
14. General Provisions
- Entire agreement: This Agreement, together with any written booking confirmation, constitutes the entire agreement between you and Nestbridge in relation to the programme booked.
- Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision shall not constitute a waiver of the right to enforce it in the future.
- Assignment: You may not assign your rights under this Agreement without prior written consent from Nestbridge.
- Notices: Written notices to Nestbridge should be sent to [email protected] or to 22, Jalan Song, 93350 Kuching, Sarawak.
15. Changes to These Terms
We may update these Terms from time to time. The current version will always be published on this page with an updated date. Continued use of our website or booking of a programme following any update constitutes acceptance of the revised Terms.
